Welcome to CelestiaMind (“the Service”). By accessing or using our Service, you (“User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you must not use the Service.
1. Service Description
CelestiaMind provides access to an AI-powered chat interface designed to assist with mental health inquiries. The Service operates as a wrapper for OpenAI’s ChatGPT model (“Third-Party Provider”).
The Service is not a substitute for professional mental health care, medical advice, or emergency intervention. If you are experiencing a mental health crisis, please contact a licensed professional or emergency services immediately.
By using the Service, you acknowledge that the AI responses are generated by OpenAI’s systems and not by us. We do not take responsibility for the accuracy, appropriateness, or outcomes of the advice or information provided by the AI.
2. Disclaimer of Liability
2.1 Third-Party Responsibility: We do not take responsibility for how OpenAI processes or stores messages exchanged through the Service. By using the Service, you acknowledge and accept OpenAI’s policies and practices regarding data usage and storage.
2.2 No Guarantees: We provide no guarantees regarding:
- The accuracy or reliability of responses generated by the AI.
- Uptime, uninterrupted access, or availability of the Service.
2.3 Assumption of Risk: The User assumes full responsibility for:
- Any decisions or actions taken based on responses from the Service.
- Proper use of the Service in accordance with these Terms.
2.4 No Professional Advice: The Service does not offer professional medical, psychological, or therapeutic advice. Responses generated by the AI are for informational purposes only and should not be relied upon for decisions.
2.5 Misuse of the Service: We are not responsible for any misuse of this Service, including but not limited to:
- Using the Service as a replacement for professional medical advice.
- Sharing sensitive or confidential information.
- Misinterpreting the responses provided by the AI.
3. Payment and Refund Policy
3.1 Subscription Fees: Access to the Service may require a paid subscription. All fees are non-refundable except as explicitly outlined in these Terms.
3.2 Limited Refunds: Refunds are only available if both of the following conditions are met:
- The User has sent fewer than 10 messages through the Service before or after purchasing a subscription.
- The refund request is submitted within 30 days of the initial subscription date.
This policy is necessary because the Service incurs non-recoverable costs for token usage when messages are processed through OpenAI. Refunds that do not meet these criteria will not be issued.
4. Acceptable Use
4.1 User Conduct: By using the Service, you agree not to:
- Use the Service for unlawful purposes or in violation of applicable laws.
- Submit content that is offensive, harmful, or violates the rights of others.
- Attempt to reverse-engineer, copy, or otherwise misuse the Service.
4.2 Message Limitations: To maintain the integrity and security of the Service and to prevent abuse or attacks, each User is limited to sending a maximum of 1,000 messages per day (or less, depending on the User's plan and Service availability). Attempts to exceed this limit may result in temporary suspension or termination of access to the Service at our sole discretion.
4.3 Suspicious Activity: To prevent abuse of the Service, we reserve the right to monitor and investigate activity that appears suspicious, including but not limited to excessive or automated message submissions aimed at filling the daily message quota. If such activity is detected, we may block or terminate the User’s access to the Service at our sole discretion.
4.4 Account Responsibility: The User is responsible for maintaining the confidentiality of their account credentials and all activity conducted under their account.
5. Limitation of Liability
To the fullest extent permitted by law, CelestiaMind, its affiliates, and its licensors shall not be liable for:
- Any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Service.
- Losses related to the accuracy, reliability, or effectiveness of responses generated by the AI.
Our total liability to any User shall not exceed the amount paid for the Service in the 30 days prior to the event giving rise to the claim.
6. Indemnification
You agree to indemnify and hold harmless CelestiaMind, its affiliates, officers, and employees from any claims, liabilities, damages, losses, or expenses arising from:
- Your use of the Service.
- Your violation of these Terms.
7. Termination of Service
We reserve the right to suspend or terminate access to the Service at our sole discretion, without notice, for any reason, including but not limited to violations of these Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes arising under these Terms shall be resolved exclusively in the courts of Poland.
9. Amendments
We reserve the right to modify these Terms at any time. Changes will become effective upon posting to the Service. Continued use of the Service after such changes constitutes acceptance of the new Terms.
